Section IX: Giving Charity to the Eight Avenues
Firstly: Giving charity to other than the eight avenues
It is not permissible to give charity to one of the eight avenues of expenditure. [935] It is not valid to use charity to build a mosque, fix roads, shroud the deceased, and the like. These are righteous acts, but are not mentioned by Allah in His Book. This is by agreement of the four schools of jurisprudence.
Secondly: Ruling of including more than one avenue
It is permissible to pay charity to solely one of the eight valid avenues of expenditure. This is the position of majority: Hanafis Malikis, and Hanbalis.
Thirdly: Giving charity to one who outwardly needs it but actually does not
Whoever gives charity to one who appears to be within the eight valid avenues of expenditure, but turns out he is not, then this payment suffices him. This is the position of the Hanafis, [936] Hanafis conditioned that, for this to be sufficient, it must be after thoroughness in searching (taharri), which is seeking out a thing with adequate effort without being able to reach its absolute reality or truth. a position among Malikis, and it is the choice of Abu `Ubayd al-Qasim ibn Sallam, Ibn Baz, and Ibn `Uthaymin.
