Section III: The Ruling of Hajj and Performing it Immediately or in the Future The Ruling of `Umrah and Repeating It
Firstly: Ruling of Hajj
Hajj is one of the pillars of Islam and a fard act. Consensus on this was narrated by Ibn al-Mundhir, Ibn Hazm, and al-Kasa’i.
Secondly: Performing it immediately or in the future
It is wajib to perform Hajj immediately when its conditions are met. This is the position of the Hanbali school, one narration from Abu Hanifah, the position of Abu Yusuf from amongst his companions, and the position of some late Malikis. It was also related from Malik and is the position of Dawud al-Zahiri. Most scholars have held this conclusion. It is the position of choice of al-Shawkani, al-Shinqiti, Ibn Baz, and Ibn `Uthaymin.
Thirdly: Ruling of `Umrah
Performing `umrah is wajib. This is the position of the Shafi`i (according to the clearest narration), Hanbali, and Zahiri schools. A group of the Salaf hold this position, and it has been ascribed to the majority of scholars. It is the position of choice of al-Shinqiti, Ibn Baz, and Ibn `Uthaymin.
Fourthly: Ruling of repeating `Umrah in a single year
It is permissible to repeat it in a single year. [951] As for what some people do during their stay in Mecca in terms of repeating `umrah and performing consecutive `umrahs, particularly during Ramadan, and also what some do in terms of performing `umrah many times after Hajj from Tan`im, Ji`ranah, and other places, though they had performed `umrah before Hajj, all of this conflicts with the guidance of the Prophet ﷺ and the way of the Salaf. There is no evidence for it being legislated. This is the position of the majority: the Hanafis, Shafi`is, Hanbalis, and some Malikis. A group of the Salaf held this position.
