Divorce upon the expiry of the four months: The majority of scholars hold the view that divorce is not established automatically upon the passing of the four months of Eelaa’. The husband is given a choice after the expiry of the four months either to divorce the wife or to resume the married life with her again (i.e., have intercourse with her). This is the view of the Maliki, Shafi’i, and Hanbali Madhabs.
2. Divorce during or after the Eelaa’: The majority of scholars hold the view that if the marriage is consummated, and then the man divorces his wife during or after the expiry of the period of Eelaa’, the divorce is considered revocable. This is the view of the Maliki, Shafi’i, and Hanbali Madhabs.
