The prohibited breastfeeding
1. Breastfeeding a child who is under two years of age: The majority of scholars hold the view that breastfeeding that proves the mahram relationship is that which takes place within the first two years of the child’s age. This is the view of the Maliki, [245]According to the Malik Madhab: two months over the two years would establish the mahram relationship. Shafi’i, the Hanbali Madhabs, the view of Abu Yusuf and Muhammad ibn al-Hassan from the Hanafi Madhab, and it is the view of some of the righteous predecessors.
2. Breastfeeding an adult [246] The case happens when a woman breastfeeds an adult. In this case, the mahram relationship is not established i.e.: the one who was breastfed by the woman is not considered her son through breastfeeding, and her children are not considered his siblings through breastfeeding. : The four Madhabs agree that the mahram relationship is not established by breastfeeding an adult. This is the view of the majority of Tab’ieen and the jurists of different regions.
3. The times of suckling that are needed to establish the mahram relationship: The minimum times of suckling so the mahram relationship is established is five times. This is the view of the Shafi’i and Hanbali Madhab, the view of some of the righteous predecessors, and the view of Ibn Hazm, Ibn Taymiyyah, al-Shawkaanee, Ibn Baaz, and Ibn ‘Uthaymeen.
2. Breastfeeding that establishes the mahram relationship: The suckling that qualifies to establish the Mahram relationship is when the infant latches onto the nipple and starts sucking, and then leaves it, and repeats the process five times, even if all the five times happen in one sitting. [247] There is a difference of opinion regarding some details between those who hold this view. The Shafi’i, scholars are of the view that the suckling of a child counts as one time in the case where switches from one nipple to another, or when he suckles from the other breast because the other one ran out of milk or leaves the nipple and then returns to latching it at once or stops suckling to take a breath. According to the Hanbali Madhab: If a boy switches from one breast to another, even if he was forced to leave it, or did it to breathe; it is counted as multiple times of breastfeeding-. This is the view of the Shafi’i and Hanbali Madhabs and the view of Ibn Taymiyyah, Ibn al-Qayyim, al-San’aanee, al-Shawkaanee, and Ibn Baaz.
