Section 3: The maintenance of the child under custody and the wage for the nursery

The maintenance of the child under custody: The four Madhabs are in consensus that the maintenance of children under custody must be covered from their own money, if available. In the event of where the child under custody lacks funds,  the person who is obligated to spend on them is obliged to cover such expenses.

The wage for the nursery: The custodian is entitled to receive compensation for taking care of the child under custody [275]    Whether the custodian is the mother or someone else. , which can be taken from the child under custody’s money if available; otherwise, from the money of the one who is obligated to spend on them. This is the view of the majority of scholars, namely the Hanafi, [276]    The Hanafi Madhab is of the view that if the mother is the custodian, and she is still deemed married to father of the child who needs custody, or if she is still in the waiting period after he issued her a revocable divorce, she is not entitled to receive a compensation for take care of the child because it is obligatory upon her in religion. However,  if the custodian is other than the mother, or if she is a divorced mother and her waiting period has expired, she deserves a compensation for taking care of the child so long as there is person who volunteers to take the custody of the child. Shafi’i [277]    According to the Shafi’i Madhab, the mother’s right to custody is forfeited if she asks for a wage and the father finds a woman who is willing to do it free of charge. , and Hanbali Madhabs [278]    According to the Hanbali Madhab, the mother’s right to custody is not forfeited if she asks for a wage that is similar to the wage given to a person doing this work, even if a woman who is willing to do it free of charge is found.   .
