Custodianship is a necessity of life that is required for healthy and good marital life. The marital house is like a kingdom that requires having one guardian who caters, safeguards, manages its affairs, and covers its financial and non-financial needs. To this end, the Wise Legislator (i.e., Allah) has assigned the husband to assume this role and fulfil this serious task because of the man’s capacity and ability to fulfil the required tasks. However, this should not be misunderstood or taken out of context as it does not entail diminishing the wife’s right because such a level of responsibility and duties fit the nature of the man. As such, Allah has assigned the man to be the guardian of the woman, which is evident in the works of the jurists from the four Madhabs [299] Their statements are numerous under the chapters of fiqh, such as marriage, divorce, maintenance, etc. .
