Section 4: Various Issues
1- Marriage on paper only: [46] This refers to marriage contracts that people conduct on paper only in order to obtain a benefit, and none of the two parties intend with it having a real marriage; thus, they do not comply with the pillars and conditions of marriage contracts in Islam. They only toy with it so that both or either of them achieve a personal benefit like residency or money, and so on.
It is not allowed to conduct a marriage contract without intending it only for the purpose of attaining a personal benefit like for the purpose of obtaining residency and so on. This is a kind of toying with the rulings of Islam, which is forbidden. This is the view of Ibn Baaz, the Permanent Committee, the European Council for Fatwa and Research, and The Assembly of Muslim Jurists of America (AMJA).
2. Conducting the marriage in the masjid:
It is permissible to conduct the marriage contract in the Masjid, which is the view of the Maliki Madhab, the view of Ibn ‘Uthaymeen and the Permanent Committee.
3. Conducting the marriage in the church:
It is impressible for the Muslim to conduct his marriage or announce it in the church, even if the bride is from the People of the Book. The ruling is applicable even if this takes place after marrying her, which is the fatwa of the Permanent Committee.
