Section 4: Consummating the Marriage before Receiving the Bride Price, Delaying the Payment of the Bride Price, and Relinquishing the Bride Price.
1- Consummating the marriage before paying the bride price:
The scholars are in consensus that it is permissible for the woman not to allow the consummation of her marriage until she receives her bride price. The consensus is transmitted by Ibn al-Munthir and al-Ramlee.
2. Relinquishing the bride price and delaying its payment:
a. Delaying the payment of the bride price: The four Madhabs [86] The Maliki Madhab allows delaying the bride price but states it is disliked and that it can be delayed if the date of marriage consummation is known or until the husband is able financially to pay all of it. agree that it is permissible to delay the payment of the bride price. [87] This permit is given to help the husband who does not have the full bride price to facilitate his marriage. However, some people have abused this ruling and used it as a pressure tool on the pretext that it will prevent the husband from divorcing his wife. It should be noted that marriage is a strong bond between the man and the woman that requires love, mutual respect, and understanding between the spouses so it can survive and be maintained. Hence, the wife should not enter into her married life all the while she fears that her husband will divorce her and therefore, she makes her marriage life subject to her delayed bride price. The married life of many women turns into hell only so the husband can force his wife to relinquish her delayed bride price. Not only does the reality prove that delaying it does not prevent the husband from divorcing the wife, but also cause more problems.
b. Relinquishing the bride price:
The scholars are in consensus that the woman can relinquish her bride price, partially or fully. The consensus is transmitted by Ibn Qudaamah and al-Qurtubee.
