Section 5: Invalid Bride Price and the Defects of the Bride Price
1- Ruling of defected bride price:
The scholars are in consensus that if the defects of the bride price are excessive, it will be rejected. The consensus is transmitted by Ibn Qudaamah.
2. Ruling of the marriage contract is the bride price is unknown or non-existent, or undeliverable:
The scholars are in consensus that if the bride price is deemed invalid because it is unknown, non-existence, or the inability of the husband to deliver it, the marriage contract is deemed valid and is not annulled. The consensus is transmitted by Ibn Qudaamah.
