Section 6: Types of divorce in respect of its occurrence during times of health and times of sickness.

The ruling on divorcing the wife while the man is not suffering terminal illness: This has been discussed in the section of the ruling of divorce.
2. The ruling on divorcing the wife during the man’s terminal illness (the fugitive’s divorce) [153] The reason it is called the fugitive’s divorce is that oftentimes the man issues a revocable divorce after knowing of his health condition so that his wife does not inherit him during her waiting period after he dies. :  The four Madhabs agree that the divorce takes place and is deemed correct if the man issues it while he is suffering a terminal illness, be it revocable or irrevocable divorce.
3. The divorce of the missing person [154] The missing person is the one is away from his family or country, or is captured by the enemy, and no one knows if he is still alive or dead and nobody knows his whereabout, and he has been missing for a long time. : The four Madhabs agree that the divorce of the man who is declared missing takes place if it is verified with evidence.
