If a wife is divorced less than three times and her husband did not take her back during the waiting period, and then he remarried her with a new marriage contract before she marries a new man. If a man divorces his wife less than three times and he does not take her back during the waiting period, he can remarry her by conducting a new marriage contract with her on the basis of whatever divorces are left for her, i.e., if the man divorced her once, she has two divorces left, and if he divorced her twice, she has one divorce left. The consensus of scholars is transmitted by al-Mawaardee, Ibn Qudaamah, al-Haytamee, al-Shirbeenee, and al-Ramlee.

If the wife is divorced less than three times and her husband did not take her back during the waiting period, and then he remarried her with a new marriage contract after she married another man and divorced her. If a man divorces his wife less than three times and does not take her back during the waiting period, and then she marries another man, and her new husband divorces her and the waiting period passes, the first husband can remarry her by conducting a new marriage contract with her on the basis of whatever divorces are left for her, i.e., if he divorced her once, she has two divorces left, and if he divorced her twice, she has one divorce left. This is the view of the majority of scholars, namely the Maliki, Shafi’i, and Hanbali Madhabs, and some Hanafi scholars. It is also the view of a group from the righteous predecessors.
3. If the wife is divorced three times and then she marries another man who divorced her afterwards, and then her former husband remarries her after the expiry of her waiting period. The scholars are in consensus that if a man divorces his wife three divorces and after the end of her waiting period, she married another man who consummated the marriage with her, and then he divorced her, the former husband can marry her again by conducting a new marriage contract, and her balance of divorces will be reset so as they will have new more three divorces again. This consensus is transmitted by Ibn al-Munthir, Ibn Hajar al-Haytamee, al-Shirbeenee and al-Ramlee.
