The ruling on appointing someone to conduct Khul’ on behalf of the spouse: The scholars are in consensus that it is permissible for the spouse to appoint someone to carry out the Khul’. The consensus was transmitted by Muafiq al-Deen Ibn Qudaamah, Abu al-Faraj Shams al-Deen Ibn Quddamah, and Burhaan al-Deen Ibn Mufleh.
2. The husband’s approval of Khul’ is conditional: The scholars differed regarding the ruling of making the husband’s approval of the khul’ subject to a condition. The majority of scholars hold the view that it is valid for the husband to suspend khul’ upon a condition, which is the opinion of the majority of the scholars: Hanafi, Maliki, and Shafi’i Madhabs. The other group of scholars hold the view that it is invalid, which is the view of the Hanbali Madhab.
