First: Maintenance for Children
The scholars are in consensus [294] There is anomalous and odd view that disagrees with this, which states that maintenance should be equal to what she would inherit from him. that the father is obliged to spend on his young children who have no money. This consensus is reported by al-Qaadi ‘Abd al-Wahhaab, al-Maawardee, Ibn Hazm, al-Kasaanee, Ibn ‘Abd al-Barr, Ibn Qudaamah, al-Qurtubee, Ibn Taymiyyah, and Ibn al-Qayyim.
Second: Maintenance for Grandchildren
The majority of scholars hold the view that it is obligatory to spend on grandchildren. This is the position of the Hanafi [295]The Hanafi Madhab is of the view that that maintenance is obligatory to every mahram kin, whether he/she can inherit from him or not. , Shafi’i, and Hanbali Madhabs. It is also the view of some of the righteous predecessors.
Third: Maintenance of the child in custody
It is obligatory to spend on the children in custody from their own money if they have money; otherwise, they should be financially supported from the wealth of the one who is obliged to spend on them [296] This is discussed in Section 5 of the Chapter of Custody. .
